In these Terms & Conditions / Privacy Policy, “Finspark Finance”, “we”, “us” and “our” mean QuikQuay Finance Pty Ltd trading as Finspark Finance.

  1. Acceptance of these terms

By accessing or using the Finspark Finance website, submitting an enquiry or using a website calculator or other website feature, you agree to these terms to the extent applicable to that activity.

If you proceed beyond an initial enquiry, additional privacy consents, credit documents, Financial Services Guides, Product Disclosure Statements, lender terms or product-provider documents may apply.

Where there is an inconsistency, a document that specifically applies to the relevant credit, insurance or warranty product will govern that product or transaction to the extent of the inconsistency.

  1. Finspark Finance’s role

Finspark Finance provides credit assistance and finance-broking services. Finspark Finance is not the lender merely because it assists with a finance enquiry or application.

Finspark Finance may collect information about your circumstances and compare potentially suitable options available through its lender panel. The number and identity of lenders available through that panel may change.

Finspark Finance does not necessarily approach, compare or assess every lender for every enquiry. The lenders and products considered will depend on factors including:

  • the type of finance requested;
  • your circumstances;
  • eligibility requirements;
  • lender policies;
  • product availability;
  • the proposed asset; and
  • the information you provide.

Any recommendation or credit assistance will be provided in accordance with applicable law and the documents given to you during the application process.

  1. No guarantee of approval or particular terms

Submitting an enquiry, receiving an initial eligibility indication, speaking with Finspark Finance or being referred to a lender does not guarantee:

  • approval for finance;
  • approval for a particular amount;
  • a particular interest rate, comparison rate, repayment, fee or loan term;
  • that no deposit will be required;
  • that a particular lender or product will be available;
  • that a lender will accept a particular vehicle, asset or security; or
  • that an application will proceed to settlement.

Finance is subject to lender approval, lending criteria, responsible-lending requirements, verification of information and any conditions imposed by the lender.

Rates, fees, products, eligibility requirements and lender policies may change without notice.

  1. Website information and disclaimers

Website content is general information only unless expressly stated otherwise. It does not take into account your objectives, financial situation or needs.

Nothing on the website constitutes:

  • an offer or approval of credit;
  • a guarantee that finance will be available;
  • financial, legal, taxation or investment advice;
  • a recommendation to acquire a particular vehicle or asset; or
  • a representation that a displayed vehicle, asset, lender or product is available.

Images of vehicles or other assets may be used for illustration only. Unless expressly stated, Finspark Finance is not the seller or supplier of a displayed vehicle or asset.

You should consider your circumstances and obtain independent professional advice where appropriate before acting on website information.

  1. Repayment calculators and estimates

Any repayment calculator on the Finspark Finance website is a general estimation tool only.

Calculator results:

  • are based on the amounts, terms and interest rates selected or displayed;
  • are not based on an approval, quote or particular lender product unless expressly stated;
  • may use a default or starting interest rate solely for illustration;
  • generally do not include fees, charges, insurance costs, balloon or residual payments or other product costs unless expressly stated;
  • do not represent a comparison rate;
  • may differ from a lender’s calculation; and
  • do not constitute an offer, quote, recommendation, pre-approval or guarantee of finance.

The following notice should also appear immediately below each calculator:

Calculator disclaimer: This calculator provides a general repayment estimate only and is not based on any particular lender or product. Results are calculated using the loan amount, term and interest rate selected and do not include fees, charges or other product costs unless stated. Actual rates, repayments, fees and eligibility will depend on the lender, product and applicant circumstances. The result is not a quote, comparison rate, offer or approval of finance.

  1. Insurance and warranty products

Where appropriately authorised, QuikQuay Finance Pty Ltd trading as Finspark Finance may arrange or assist with insurance and warranty products provided by third-party product issuers.

The relevant Financial Services Guide, Product Disclosure Statement and other product documentation will identify:

  • the product issuer;
  • the applicable Australian Financial Services Licence holder;
  • Finspark Finance’s capacity or appointment in relation to the product; and
  • the terms, conditions, exclusions, eligibility criteria and limits that apply.

Finspark Finance does not issue an insurance or warranty product unless the applicable product documentation expressly states otherwise.

You should read the applicable Financial Services Guide, Product Disclosure Statement, Target Market Determination and other product documentation before acquiring an insurance or warranty product.

  1. Accuracy of information supplied by you

You must provide information that is accurate, complete and current.

Finspark Finance, prospective lenders and product providers may rely on the information and documents you provide. Inaccurate, incomplete or misleading information may:

  • prevent Finspark Finance from assisting you;
  • delay or adversely affect an application;
  • cause a lender or provider to decline or withdraw an approval;
  • result in different rates, fees or conditions; or
  • have other legal consequences.

You should promptly tell Finspark Finance if information you have provided changes or you discover that it is incorrect.

  1. Initial enquiries and credit enquiries

Submitting an initial website enquiry form to Finspark Finance does not itself constitute a formal credit application to a lender and does not, by itself, cause Finspark Finance to make a credit enquiry that affects your credit score.

If you decide to proceed, Finspark Finance will explain any additional information, documents and consents required.

A formal application or lender submission may involve a credit enquiry by the relevant lender or another authorised participant. This will occur only at the appropriate stage and subject to the applicable authority or consent.

After receiving the required written authority and privacy consent, Finspark Finance may act as an Access Seeker to obtain a copy of your credit information or consumer credit report from a credit reporting body.

An Access Seeker request is used to obtain access to your credit information on your behalf and is distinct from a lender making a formal credit application enquiry.

  1. Intellectual property and third-party services

Unless otherwise stated, the content of the Finspark Finance website—including its text, layout, graphics, logos, branding, photographs, illustrations and software—is owned by or licensed to Finspark Finance and is protected by applicable intellectual-property laws.

You may access and use the website for personal and lawful purposes. You must not reproduce, modify, republish, distribute, commercially exploit or falsely attribute website content without prior written permission, except where permitted by law.

Third-party names, logos and trademarks remain the property of their respective owners. Their appearance does not necessarily indicate sponsorship, endorsement or affiliation.

The website may link to third-party websites, tools, platforms or services. Finspark Finance does not control those services and is not responsible for their content, availability, security or privacy practices.

Finspark Finance takes reasonable steps to keep website information accurate and the website available but does not guarantee that the website will always be uninterrupted, error-free or current.

Nothing in these terms excludes, restricts or modifies a right, guarantee or remedy that cannot lawfully be excluded under the Australian Consumer Law or another applicable law.

Privacy Policy

  1. Privacy commitments

Finspark Finance respects the privacy of personal information and credit-related information.

Finspark Finance manages information in accordance with applicable requirements, including the:

  • Privacy Act 1988 (Cth);
  • Australian Privacy Principles;
  • Privacy (Credit Reporting) Code 2024, where applicable;
  • Notifiable Data Breaches scheme; and
  • other applicable privacy, credit and communications laws.

This policy explains:

  • what information Finspark Finance collects and holds;
  • how that information is collected;
  • why it is collected, used and disclosed;
  • the organisations to which it may be disclosed;
  • how it is protected;
  • how you may request access or correction; and
  • how you may make a complaint.

“Personal information” means information or an opinion about an identified individual, or an individual who is reasonably identifiable.

“Credit-related information” may include identification information, credit accounts, credit applications and enquiries, repayment history, defaults, hardship information, insolvency and court information, credit-reporting information and information derived from a credit report.

  1. Information Finspark Finance may collect

Depending on your dealings with Finspark Finance, information collected may include:

  • your name, date of birth and contact details;
  • residential and previous addresses;
  • residency or visa status;
  • driver licence, passport, proof-of-age card, Medicare card and other identification information;
  • relationship status, dependants and household circumstances;
  • employment status, occupation, employer and employment history;
  • income, expenses, assets and liabilities;
  • bank-account details, transaction information and bank statements;
  • payslips, tax returns and other evidence of income;
  • the amount, purpose and type of finance requested;
  • deposit, trade-in and existing-finance information;
  • information about a proposed vehicle or other asset;
  • credit information and information derived from a credit report;
  • correspondence, electronic signatures and records of communications;
  • enquiry, application, complaint and transaction history;
  • recordings of telephone conversations; and
  • website and technical information.

Website and technical information may include:

  • IP address;
  • browser, device and operating-system information;
  • pages viewed and website interactions;
  • referral and advertising source;
  • dates and times of access;
  • cookies, pixels and similar identifiers;
  • form interactions and conversion events; and
  • approximate location inferred from technical information.

Finspark Finance may also collect information relating to guarantors, joint applicants, authorised representatives, referrers, employees, prospective employees, contractors and business contacts.

  1. Tax File Numbers and sensitive information

Finspark Finance does not ordinarily request or require your Tax File Number.

If you provide a document containing a Tax File Number, Finspark Finance will take reasonable steps to redact or securely delete the Tax File Number where it is not required or permitted to be retained.

Despite reasonable procedures, a Tax File Number may occasionally be received or temporarily retained as a result of human or technical error. If identified, Finspark Finance will take appropriate steps to redact, restrict or securely delete it.

Finspark Finance does not ordinarily request health information. Sensitive information will only be collected where authorised by law, with consent where required, and where reasonably necessary for the relevant function or activity.

  1. How information is collected

Finspark Finance may collect information:

  • directly from you through website forms, telephone calls, emails, SMS, electronic-signing processes and documents you provide;
  • from a joint applicant, guarantor or authorised representative;
  • through its aggregator and customer-management systems;
  • from credit reporting bodies, including through an authorised Access Seeker request;
  • through bank-statement and document-verification services;
  • from lenders, insurers, warranty providers and product issuers;
  • from employers, accountants, referees, dealers or asset suppliers where authorised;
  • from public registers and publicly available sources;
  • through identity-verification and fraud-prevention services;
  • through website, analytics and advertising technologies; and
  • from other parties with your consent or where authorised by law.

Where reasonable and practicable, Finspark Finance collects personal information directly from you.

If you provide information about another person, you must be authorised to do so and should make that person aware of this policy where appropriate.

  1. Why information is collected, used and disclosed

Finspark Finance may collect, hold, use and disclose information to:

  • respond to and manage an enquiry;
  • contact you about your enquiry;
  • conduct preliminary eligibility screening;
  • provide credit assistance and finance-broking services;
  • identify and compare potentially suitable finance options;
  • prepare, submit and manage finance applications;
  • verify identity, income, expenses, employment and other information;
  • obtain information under an authorised Access Seeker request;
  • communicate with lenders, aggregators and service providers;
  • arrange settlement or manage post-settlement matters;
  • arrange or assist with insurance or warranty products where appropriately authorised;
  • prevent or investigate suspected fraud, misconduct or unlawful activity;
  • manage risk, quality assurance, staff training and compliance;
  • respond to complaints;
  • operate, secure, maintain and improve the website and services;
  • measure website and advertising performance;
  • comply with legal, licensing, regulatory and record-keeping obligations;
  • establish, exercise or defend legal rights; and
  • undertake another purpose with your consent or as permitted by law.

If required information is not provided, Finspark Finance may be unable to assess your enquiry, provide credit assistance or progress an application.

  1. Initial eligibility screening and automated processes

Finspark Finance uses form rules and automated processes to collect, screen, classify and route enquiries.

Information used by these processes may include:

  • age;
  • residency status;
  • employment and income information;
  • the finance type or amount requested;
  • asset information;
  • bankruptcy or insolvency information; and
  • other answers supplied through an enquiry form.

These processes may:

  • determine which questions or form pathway is displayed;
  • classify or prioritise an enquiry;
  • direct an enquiry to an appropriate workflow; or
  • indicate that Finspark Finance is unable to assist at that time.

This screening is an assessment of Finspark Finance’s ability to assist based on the information supplied and the rules then in use. It is not a lender’s credit decision, a formal decline or an assessment by every lender on the Finspark Finance panel.

  1. Credit reports, credit reporting bodies, bank statements and verification

After receiving the required written authority and privacy consent, Finspark Finance may act as an Access Seeker and request access to your credit information from Equifax on your behalf.

Finspark Finance may use lawfully obtained credit-related information to:

  • assess whether Finspark Finance may be able to assist;
  • identify potentially suitable lender options;
  • provide credit assistance;
  • verify information relevant to an application;
  • submit information to a lender with your authority; and
  • comply with legal and regulatory obligations.

An Access Seeker request is made on your behalf and is distinct from a lender making a formal credit application enquiry.

When a formal application is submitted, the prospective lender may conduct its own credit enquiry and obtain information from one or more credit reporting bodies. Depending on the lender, these may include Equifax, illion or Experian. The lender’s enquiry, use and disclosure of credit-related information will be governed by the lender’s own privacy and credit-reporting policy.

You may contact a credit reporting body to:

  • request access to or correction of information it holds about you;
  • request that your credit-reporting information not be used for eligible direct-marketing pre-screening; or
  • request a temporary ban on disclosure if you believe you have been or may be a victim of fraud.

Where required, Finspark Finance may obtain bank-statement information through a secure bank-statement service. If your financial institution is not supported, Finspark Finance may accept statements or other documents supplied directly by you.

Bank-statement information may be used to verify income, expenses, liabilities, account conduct and other matters relevant to an enquiry or application.

Finspark Finance may provide identity documents and application information to prospective lenders. Lenders and their service providers may perform their own identity, fraud-prevention, credit-reporting and verification checks.

  1. Telephone calls and communications

Telephone calls to or from Finspark Finance may be recorded and retained for:

  • quality assurance;
  • staff training;
  • verification of information or instructions;
  • complaint management;
  • compliance;
  • fraud prevention; and
  • dispute resolution.

Call recordings may contain personal, financial and credit-related information discussed during the call. Access is restricted to personnel and service providers who require it for an authorised purpose.

If you do not want a call recorded, you may tell the Finspark Finance representative and ask whether another communication method is available.

Finspark Finance may contact you using the telephone number, email address or other contact details you provide in connection with your enquiry or application.

Contact about an active enquiry is service-related communication and is not necessarily marketing. Finspark Finance will respect a request to stop contact, subject to communications required by law or reasonably necessary to manage an existing application, transaction or complaint.

  1. Disclosure to service providers and other organisations

Finspark Finance may disclose personal information, where relevant and permitted, to:

  • prospective and existing lenders, aggregators and credit-assistance providers;
  • credit reporting bodies and Access Seeker service providers;
  • bank-statement, identity-verification and fraud-prevention providers;
  • insurers, warranty providers and product issuers;
  • dealers, vendors, referrers and asset suppliers;
  • website-hosting, cloud-storage, customer-management, electronic-signature, communications, analytics and advertising providers;
  • accountants, lawyers, auditors, compliance consultants and other professional advisers;
  • joint applicants, guarantors and authorised representatives;
  • regulators, courts, law-enforcement bodies and dispute-resolution schemes;
  • a purchaser, investor or adviser involved in a proposed sale, restructure or transfer of the business; and
  • other persons where you consent or where disclosure is required or permitted by law.

Finspark Finance does not sell personal information.

  1. Cookies, analytics and advertising technology

The Finspark Finance website may use cookies, pixels and similar technologies to:

  • operate and secure the website;
  • understand website use;
  • identify the source of enquiries;
  • measure advertising and conversions;
  • improve website performance and services; and
  • build or measure advertising audiences where permitted.

These technologies may collect information such as your IP address, device and browser information, pages viewed, website interactions, referral source and conversion events.

You may be able to control cookies through your browser or applicable website consent settings. Disabling cookies may affect some website functions.

Finspark Finance will not upload identifiable customer lists or use customer information for advertising audience matching unless that use is permitted by law and covered by an appropriate notice, consent or other valid authority.

  1. Direct marketing

Finspark Finance may use personal information for direct marketing only where permitted by law.

Finspark Finance may send information about products or services where you have consented or where applicable law otherwise permits it. Marketing communications will provide a reasonable way to opt out where required.

You may opt out by:

  • using the unsubscribe facility in the communication;
  • telling a Finspark Finance representative;
  • calling 1300 131 377; or
  • emailing marketing@finspark.com.au.

Finspark Finance will not charge you for making an opt-out request and will take reasonable steps to action it promptly.

A request to stop marketing does not prevent Finspark Finance from sending communications necessary to manage an existing enquiry, application, transaction, complaint or legal obligation.

  1. Storage, security and retention

Finspark Finance may hold information electronically and, in limited circumstances, in paper form. Electronic information may be held in Finspark Finance’s systems or in systems operated by authorised service providers.

Finspark Finance takes reasonable steps to protect information from misuse, interference, loss and unauthorised access, modification or disclosure.

Security measures may include:

  • access controls and authentication;
  • restricted staff permissions;
  • secure electronic systems;
  • logging and audit records;
  • staff training and confidentiality obligations;
  • secure document-transfer processes;
  • provider due diligence; and
  • incident and complaint-management procedures.

No method of electronic transmission or storage can be guaranteed to be completely secure.

Finspark Finance retains information for as long as reasonably necessary to provide services, manage complaints or disputes, comply with legal and regulatory requirements or protect legitimate legal interests.

Information may be retained after an enquiry or application is closed. Retention periods may differ depending on:

  • whether the matter remained an enquiry or became a formal application;
  • whether finance, insurance or a warranty product was arranged;
  • applicable legal and licensing requirements;
  • the nature and sensitivity of the information;
  • complaint, dispute, fraud or enforcement risks; and
  • system backup and archival processes.

Where information is no longer required or authorised to be retained, Finspark Finance will take reasonable steps to securely destroy or permanently de-identify it.

An opt-out or request not to be contacted may be retained in a suppression record to ensure the person is not contacted again.

  1. Overseas handling of information

Finspark Finance primarily uses Australian lenders, aggregators and service providers. Some technology providers used to operate the website, communications, analytics and advertising services may process or store limited personal or technical information outside Australia.

Where Finspark Finance is likely to disclose personal information to an overseas recipient, Finspark Finance will take reasonable steps required by applicable privacy law and will provide information about the likely location where it is practicable to do so.

  1. Government identifiers

Finspark Finance may collect government-issued identity information where reasonably necessary for identity, lender or legal requirements.

Finspark Finance will not adopt a government identifier as its own identifier and will not use or disclose a government identifier except where permitted by law.

Tax File Numbers are handled as described in section 13.

  1. Access and correction

You may request access to, or correction of, personal or credit-related information Finspark Finance holds about you by emailing compliance@finspark.com.au.

Finspark Finance may need to verify your identity before providing access or making a correction.

Finspark Finance will respond within a reasonable period and may refuse or limit access or correction where permitted by law.

If a request is refused, Finspark Finance will generally provide written reasons and information about available complaint mechanisms, unless it would be unreasonable or unlawful to do so.

Finspark Finance will not charge for making a request. Where permitted, reasonable administrative costs associated with providing access may be charged after notice is given.

If Finspark Finance refuses to correct information, you may ask Finspark Finance to associate a statement with the information indicating that you consider it inaccurate.

  1. Data breaches

Finspark Finance maintains procedures for responding to suspected privacy and data-security incidents.

Where an eligible data breach occurs, Finspark Finance will comply with the Notifiable Data Breaches scheme, including notifying affected individuals and the Office of the Australian Information Commissioner where required.

Continued use of the website after an update does not constitute consent to a new use or disclosure of personal information where separate consent is legally required.

  1. Governing law

These website terms are governed by the laws of Queensland, Australia.

You submit to the non-exclusive jurisdiction of the courts of Queensland and courts entitled to hear appeals from them.

Nothing in this section limits a right to bring a complaint or proceeding in another jurisdiction where applicable law permits or requires it.
